A Unicity cab driver has been acquitted of sexually assaulting a woman he picked up.
Justice Sadie Bond of Manitoba Court of Queen’s Bench said today that while she didn’t disbelieve the 39-year-old woman’s story she still had to acquit the 48-year-old man.
“While I have suspicions with the accused’s story… It is consistent and he was not shaken by cross examination,” Bond said.
“I am left with a reasonable doubt and I must acquit.”
Court was told during a trial last year that the woman was walking home when she accepted a ride from a cab driver who said he was heading home in her direction on Aug. 17, 2011.
The cab drove to a nearby cemetery where the woman said she was sexually assaulted while the driver said she had asked to go there and he had ordered her out of the cab when she wanted to go somewhere else.
